Online Payment Policy
1. Online Payments
MELEE Development provides secure online payment facilities for property reservations, booking amounts, installments, and other applicable payments through approved payment channels and payment service providers operating in accordance with applicable Central Bank of Egypt requirements and relevant banking arrangements.
Payments are processed through secure payment infrastructure in accordance with applicable payment security standards. MELEE Development does not store clients’ payment card details.
Clients must make online payments only through MELEE Development’s official website or official payment links issued or authorized by MELEE Development.
1. المدفوعات الإلكترونية
توفر شركة MELEE Development وسائل دفع إلكترونية آمنة لسداد مبالغ حجز الوحدات، ومقدمات الحجز، والأقساط، وأي مدفوعات أخرى واجبة السداد، وذلك من خلال قنوات دفع معتمدة ومقدمي خدمات دفع يعملون وفقًا لمتطلبات البنك المركزي المصري والترتيبات المصرفية ذات الصلة.
تتم معالجة المدفوعات من خلال بنية تحتية آمنة للدفع ووفقًا لمعايير الأمان المعمول بها. ولا تقوم شركة MELEE Development بتخزين بيانات بطاقات الدفع الخاصة بالعملاء.
يجب على العملاء إجراء المدفوعات الإلكترونية فقط من خلال الموقع الرسمي لشركة MELEE Development أو من خلال روابط الدفع الرسمية الصادرة أو المعتمدة من الشركة.
2. Payment Confirmation & Settlement
An online payment shall be considered finally received by MELEE Development only after the transaction has been successfully verified and the relevant funds have been credited and/or settled into MELEE Development’s designated bank account.
Any success notification generated by the payment gateway, issuing bank, mobile wallet, or other payment channel constitutes an initial transaction confirmation only and does not, by itself, constitute final confirmation of receipt by MELEE Development.
Settlement and verification typically require 1–3 business days, depending on the payment method, issuing bank, acquiring bank, and payment service provider.
Clients are responsible for retaining the transaction reference number and payment confirmation until final confirmation is received from MELEE Development.
2. تأكيد المدفوعات والتسوية
يُعتبر الدفع الإلكتروني مستلمًا بشكل نهائي من قبل MELEE Development فقط بعد التحقق من نجاح العملية وقيد و/أو تسوية المبلغ فعليًا في الحساب البنكي المحدد للشركة.
أي رسالة نجاح أو تأكيد صادرة عن بوابة الدفع أو البنك المُصدر للبطاقة أو المحفظة الإلكترونية أو أي قناة دفع أخرى تُعد تأكيدًا أوليًا للعملية فقط، ولا تُعتبر بمفردها تأكيدًا نهائيًا باستلام MELEE Development للمبلغ.
عادةً ما تستغرق عملية التسوية والتحقق من يوم إلى ثلاثة أيام عمل، وفقًا لطريقة الدفع، والبنك المُصدر، والبنك المحصل، ومقدم خدمة الدفع.
يتحمل العميل مسؤولية الاحتفاظ بالرقم المرجعي للعملية وإثبات الدفع حتى استلام التأكيد النهائي من MELEE Development.
3. Reservation Payments
A reservation payment is made for the purpose of securing a specific property unit and, upon successful completion of the transaction and subsequent contracting, shall form part of the total purchase price of the relevant unit.
Payment of a reservation amount does not, by itself, constitute a final sale, transfer of ownership, or binding sale agreement unless expressly confirmed by MELEE Development through the execution of the applicable reservation form, booking documentation, and/or sale agreement, as applicable.
The availability of a unit remains subject to MELEE Development’s final verification of payment and confirmation of the reservation.
3. مدفوعات الحجز
يتم سداد مبلغ الحجز بغرض تخصيص وحدة عقارية محددة للعميل، ويُعتبر هذا المبلغ، بعد إتمام العملية بنجاح واستكمال إجراءات التعاقد، جزءًا من إجمالي سعر شراء الوحدة محل الحجز.
ولا يُعد سداد مبلغ الحجز في حد ذاته بيعًا نهائيًا أو نقلًا للملكية أو عقد بيع ملزمًا، ما لم يتم تأكيد ذلك صراحةً من جانب MELEE Development من خلال توقيع نموذج الحجز و/أو مستندات الحجز و/أو عقد البيع المعمول به، بحسب الحالة.
ويظل توافر الوحدة خاضعًا للتحقق النهائي من استلام قيمة الحجز وتأكيد الحجز من جانب MELEE Development.
4. Reservation Cancellation & Non-Refundability
Subject at all times to applicable Egyptian law and any mandatory rights available to the client, reservation payments are generally intended to secure the relevant unit and remove it from availability for sale to other prospective purchasers.
Where the client voluntarily elects not to proceed with the contracting process after reservation, any cancellation, refund, or retention of the reservation amount shall be governed by the terms and conditions stipulated in the Reservation Form duly signed by the client, subject to applicable Egyptian law and any mandatory statutory rights.
Nothing in this Policy shall limit or exclude any refund, cancellation, or withdrawal right that cannot legally be waived under applicable Egyptian law.
As an additional customer service arrangement, and without prejudice to any statutory rights, MELEE Development may, at its sole discretion and subject to availability, permit a reservation amount to be transferred to another available unit or project if the request is submitted within 7 calendar days from the original payment date.
Any such transfer shall remain subject to MELEE Development’s written approval and the commercial terms applicable to the replacement unit or project.
4. إلغاء الحجز وعدم رد مبالغ الحجز
مع مراعاة أحكام القانون المصري المعمول به وأي حقوق إلزامية مقررة للعميل، فإن مبالغ الحجز تهدف في الأصل إلى تأمين الوحدة محل الحجز واستبعادها من قائمة الوحدات المتاحة للبيع للعملاء الآخرين.
في حال قرر العميل بمحض إرادته عدم استكمال إجراءات التعاقد بعد إتمام الحجز، فإن إلغاء الحجز وأي استرداد لمبلغ الحجز أو احتفاظ الشركة به، كليًا أو جزئيًا، يخضع للشروط والأحكام المنصوص عليها في استمارة الحجز الموقعة من العميل، وذلك مع مراعاة أحكام القانون المصري المعمول به وأي حقوق قانونية إلزامية مقررة للعميل.
ولا يجوز تفسير أي حكم من أحكام هذه السياسة على نحو يؤدي إلى تقييد أو استبعاد أي حق قانوني إلزامي للعميل في الاسترداد أو الإلغاء أو العدول لا يجوز التنازل عنه وفقًا للقانون المصري.
وكإجراء إضافي لخدمة العملاء، ودون الإخلال بأي حقوق قانونية مقررة للعميل، يجوز لشركة MELEE Development، وفقًا لتقديرها الخاص ومع مراعاة توافر الوحدات، السماح بتحويل مبلغ الحجز إلى وحدة أخرى متاحة أو مشروع آخر، بشرط تقديم الطلب خلال 7 أيام تقويمية من تاريخ الدفع الأصلي.
ويظل أي تحويل من هذا النوع خاضعًا للموافقة الكتابية من MELEE Development وللشروط التجارية المطبقة على الوحدة أو المشروع البديل.
5. Failed, Pending, or Unsuccessful Payments
If a payment transaction is declined, interrupted, cancelled, or otherwise unsuccessful, the client should not assume that payment has been received by MELEE Development.
Where the client’s bank account, payment card, or wallet has been debited but MELEE Development has not confirmed receipt of the payment, the client must contact MELEE Development’s Finance Department before attempting another payment.
The client should provide:
- Transaction reference number;
- Transaction date;
- Amount paid; and
- Payment method.
Clients should not make repeated payments for the same reservation while an earlier transaction remains under investigation.
5. المدفوعات المرفوضة أو المعلقة أو غير الناجحة
في حال رفض عملية الدفع أو انقطاعها أو إلغائها أو عدم إتمامها لأي سبب، يجب ألا يفترض العميل أن المبلغ قد تم استلامه من جانب MELEE Development.
وفي حال خصم المبلغ من الحساب البنكي أو بطاقة الدفع أو المحفظة الإلكترونية الخاصة بالعميل دون تأكيد MELEE Development لاستلامه، يجب على العميل التواصل مع الإدارة المالية بالشركة قبل محاولة إجراء عملية دفع أخرى.
ويتعين على العميل تقديم البيانات التالية:
- الرقم المرجعي للعملية؛
- تاريخ العملية؛
- قيمة المبلغ المدفوع؛
- وسيلة الدفع المستخدمة.
وينبغي على العملاء عدم تكرار الدفع عن نفس الحجز طالما أن عملية دفع سابقة لا تزال قيد الفحص أو التحقق.
6. Duplicate or Incorrect Payments
Where a client makes a duplicate payment or pays an incorrect amount, MELEE Development shall investigate and verify the relevant transaction.
Where a refund is approved, the refund will normally be processed through the original payment method, subject to banking and payment-provider procedures.
Approved refunds will generally be initiated within 7–14 business days from approval, although the actual date on which funds are credited to the client’s account may depend on the relevant bank, card issuer, and payment service provider.
Where permitted by applicable law and the relevant contractual arrangements, actual non-recoverable payment-processing or banking charges may be deducted from the refunded amount.
No such deduction shall apply where prohibited by applicable law or where the refund results from an error attributable to MELEE Development.
6. المدفوعات المكررة أو غير الصحيحة
في حال قيام العميل بسداد مبلغ مكرر أو سداد مبلغ غير صحيح، تقوم MELEE Development بمراجعة العملية والتحقق منها.
وفي الحالات التي تتم فيها الموافقة على رد المبلغ، يتم رد المبلغ عادةً من خلال وسيلة الدفع الأصلية، وذلك وفقًا للإجراءات البنكية وإجراءات مقدم خدمة الدفع.
يتم عادةً بدء إجراءات رد المبالغ المعتمدة خلال 7 إلى 14 يوم عمل من تاريخ الموافقة، مع العلم بأن تاريخ وصول المبلغ فعليًا إلى حساب العميل قد يختلف وفقًا للبنك المعني، أو البنك المُصدر للبطاقة، أو مقدم خدمة الدفع.
ويجوز، حيثما يسمح القانون المعمول به والترتيبات التعاقدية ذات الصلة، خصم رسوم معالجة الدفع أو المصروفات البنكية الفعلية وغير القابلة للاسترداد من قيمة المبلغ المرتد.
ولا يتم تطبيق أي خصم من هذا النوع إذا كان القانون يحظر ذلك أو إذا كان سبب رد المبلغ ناتجًا عن خطأ من جانب MELEE Development.
7. Refunds & Chargebacks
Refunds are subject to applicable Egyptian law together with the terms of the relevant reservation form, booking documentation, payment schedule, and executed sale agreement, as applicable.
Any mandatory consumer rights under Egyptian law shall remain unaffected.
Refund processing periods may vary depending on the client’s bank, card issuer, payment method, and payment service provider.
Clients are encouraged to contact MELEE Development’s Finance Department to resolve any payment discrepancy before initiating a chargeback.
Fraudulent, abusive, or unjustified chargeback claims may result in suspension or cancellation of the relevant reservation where permitted under the applicable contractual arrangements and Egyptian law.
Nothing in this clause restricts a client’s lawful right to dispute an unauthorized or incorrectly processed transaction.
7. رد المبالغ والاعتراضات على المدفوعات
تخضع عمليات رد المبالغ لأحكام القانون المصري المعمول به، بالإضافة إلى شروط نموذج الحجز أو مستندات الحجز أو جدول السداد أو عقد البيع الموقع، بحسب الحالة.
ولا تتأثر بأي حال الحقوق الإلزامية للمستهلك التي يقررها القانون المصري.
وقد تختلف المدة اللازمة لاستكمال رد المبالغ وفقًا لبنك العميل، والبنك المُصدر للبطاقة، وطريقة الدفع، ومقدم خدمة الدفع.
ويُفضل أن يقوم العملاء بالتواصل أولًا مع الإدارة المالية في MELEE Development لمحاولة تسوية أي اختلاف أو مشكلة متعلقة بالدفع قبل تقديم طلب اعتراض أو Chargeback من خلال البنك أو جهة إصدار البطاقة.
ويجوز أن يترتب على الاعتراضات الاحتيالية أو التعسفية أو غير المبررة تعليق أو إلغاء الحجز، وذلك في الحدود التي تسمح بها الترتيبات التعاقدية المعمول بها وأحكام القانون المصري.
ولا يحد هذا البند من حق العميل القانوني في الاعتراض على أي عملية دفع غير مصرح بها أو تمت معالجتها بصورة غير صحيحة.
8. Security, Electronic Invoicing & Client Responsibility
Clients are responsible for reviewing and confirming all relevant information before completing payment, including:
- Payment amount;
- Unit and project details;
- Client details;
- Reservation terms; and
- Applicable payment and contractual conditions.
MELEE Development will issue the applicable electronic invoice and/or electronic receipt, where required, in accordance with applicable Egyptian Tax Authority regulations.
Clients must immediately notify MELEE Development if they suspect any unauthorized payment activity or receive a payment request through an unofficial channel.
MELEE Development will never request clients to disclose complete payment card credentials, PIN numbers, or one-time passwords (OTPs) outside the secure payment environment.
8. الأمان والفوترة الإلكترونية ومسؤولية العميل
يتحمل العميل مسؤولية مراجعة والتأكد من جميع البيانات ذات الصلة قبل إتمام عملية الدفع، بما في ذلك:
- قيمة المبلغ المستحق؛
- بيانات الوحدة والمشروع؛
- بيانات العميل؛
- شروط الحجز؛
- وشروط الدفع والتعاقد المعمول بها.
تقوم MELEE Development بإصدار الفاتورة الإلكترونية و/أو الإيصال الإلكتروني، بحسب ما تقتضيه الحالة، وفقًا للوائح والتعليمات المعمول بها لدى مصلحة الضرائب المصرية.
ويتعين على العميل إخطار MELEE Development فورًا في حال الاشتباه في أي نشاط دفع غير مصرح به أو في حال تلقي أي طلب للسداد من خلال قناة غير رسمية.
ولا تطلب MELEE Development من العملاء الإفصاح عن بيانات بطاقة الدفع الكاملة أو الرقم السري للبطاقة أو رموز التحقق لمرة واحدة OTP خارج بيئة الدفع الإلكترونية الآمنة.
9. Applicable Law & Dispute Resolution
This Policy shall be governed by and interpreted in accordance with the laws of the Arab Republic of Egypt.
Any dispute arising in connection with online payments shall be subject to the jurisdiction of the competent Egyptian courts in accordance with applicable law.
This Policy should be read together with the applicable reservation form, booking terms, payment schedule, and final sale agreement.
In the event of any inconsistency between this Policy and a duly executed contractual agreement, the executed agreement shall prevail, except where mandatory provisions of applicable Egyptian law provide otherwise.
9. القانون واجب التطبيق وتسوية النزاعات
تخضع هذه السياسة وتُفسر وفقًا لقوانين جمهورية مصر العربية.
وتخضع أي منازعة تنشأ فيما يتعلق بالمدفوعات الإلكترونية لاختصاص المحاكم المصرية المختصة وفقًا للقانون المعمول به.
ويجب قراءة هذه السياسة بالاقتران مع نموذج الحجز وشروط الحجز وجدول السداد وعقد البيع النهائي، بحسب الحالة.
وفي حال وجود أي تعارض بين أحكام هذه السياسة وأحكام عقد تم توقيعه أصولًا بين الأطراف، تكون الأولوية لأحكام العقد الموقع، ما لم توجد أحكام إلزامية في القانون المصري تقضي بخلاف ذلك.
